In order to provide our Services, we may need to process Personal Data from time to time (that is information about someone who can be identified from the data). This Personal Data may be about you or other people. This notice explains how we will use the Personal Data we hold.

1. Your personal data – what is it?

Personal data relates to a living individual who can be identified from that data.  Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is governed by the General Data Protection Regulation (the “GDPR”).

2. Who are we?

The Lincoln Diocesan Board of Education is the data controller (contact details above). This means it decides how your personal data is processed and for what purposes.

What information do we collect?

Our website utilises online forms for you to contact us and register for events.

We currently collect and process the following information:

  • Personal identifiers, contacts and characteristics (for example, name and contact details)

 All personal data is managed in accordance with our obligations as a Data Controller.

It is likely that some of the Personal Data which we collect and store about you may include Special Categories of Personal Data. Special Categories of Personal Data includes details about an individual’s race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about health and genetic and biometric data.

You may choose to restrict the collection or use of your personal information in the following ways:

•    Whenever you are asked to fill in a form on the website, look for a box that you can tick to indicate that you do not want your information to be used for direct marketing.

•    If you have previously agreed to us using your personal information for direct marketing, you may change your mind at any time by writing to us or using the contact form on the website.

3. How do we process your personal data?

The Lincoln Diocesan Board of Education complies with its obligations under the UK GDPR (Data Protection Act 2018) by: -

  • keeping personal data up to date;
  • by storing and destroying it securely;
  • by not collecting or retaining excessive amounts of data;
  • by protecting personal data from loss, misuse, unauthorised access and disclosure; and
  • by ensuring that appropriate technical measures are in place to protect personal data.

We use your personal data for the following purposes: -

  • To administer records of: -
    • Governors;
    • Bishop's Visitors;
    • Headteachers
    • DBE Committees
  • To promote the interests of the Lincoln Diocesan Board of Education;
  • To maintain our own accounts and records 
  • To inform you of news, events, activities and services run by the Lincoln Diocesan Board of Education: -
    • Mailings (by email &/or hard copy)

4. What is the legal basis for processing your personal data?

We hold and process your data as a Controller, which means we must have a ‘lawful basis’ for doing so. We have set out how we use your data along with our lawful basis below.

Anywhere we are relying on legitimate interest we believe that such processing is necessary for the purposes of our legitimate interest, which in this case is to function as a Board of Education. We consider such use goes no further than the Data Subject would reasonably expect; is likely to align with the Data Subject’s interests and is unlikely to be detrimental to the fundamental rights and freedoms of the Data Subject.

  • To manage our relationship with you, identity data and contact data are necessary. This enables performance of any contract with you and the provision of our services or taking steps necessary to enter into a contract. This is a legitimate interest.
  • Marketing requires us to collect identity data, contact data, transaction data, profile data, and traffic data. This is a legitimate interest that may require consent.
  • Keep you informed about news, events, activities and services and keep you informed about our events;
  • There is no disclosure to a third party without consent except as set out in 5 below

5. Sharing your personal data

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

Your personal data will be treated as strictly confidential and will only be shared within the Lincoln Diocesan Board of Education, for purposes connected with the LDBE, and certain third parties outside the Diocese as set out in Annex A.

6. How long do we keep your personal data?

We keep data in accordance with the guidance set out in the guide “Save or Delete: the Care of Diocesan Records” which is available from the Church of England website at https://www.churchofengland.org/more/libraries-and-archives/records-management-guides.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

7. Your rights and your personal data 

Unless subject to an exemption under the UK GDPR, you have the following rights with respect to your personal data: -

  • The right to request a copy of your personal data which the Lincoln Diocesan Board of Education holds about you. If you would like to request a copy of your personal data, please contact us.
  • The right to request that the Lincoln Diocesan Board of Education corrects any personal data if it is found to be inaccurate or out of date;
  • The right to request your personal data is erased where it is no longer necessary for the Lincoln Diocesan Board of Education retain such data;
  • The right to withdraw your consent to the processing at any time
  • The right to request that the data controller provide the data subject with his/her personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability).
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
  • The right to object to the processing of personal data, (where applicable);
  • The right to lodge a complaint with the Information Commissioners Office.

If you believe that any information we are holding on you is incorrect or incomplete, please let us know as soon as possible. We will promptly correct any information found to be incorrect.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

If we are holding Personal Data about you and using that data for marketing purposes or for any other activities based on your consent, you may notify us at any time that you no longer want us to process Personal Data about you for particular purposes or for any purposes whatsoever, and we will stop processing your Personal Data for that purpose. This will not affect your ability to receive our Services.

8. Further processing

If we wish to use your personal data for a new purpose, not covered by this Data Protection Notice, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.
